Terms of Use

These Terms of Use (“Terms”) govern your access to and use of all digital products, guides, workbooks, sales pages, webinars, workshops, downloads, and other educational content (collectively, the “Materials”) provided by Ajanaclair Wise Law PLLC (“AWL,” “we,” “us,” or “our”), together with our affiliates, successors, assigns, contractors, and members (collectively, the “Affiliates”). By purchasing, accessing, or using any of the Materials, you agree to be bound by these Terms. If you do not agree, you may not access or use the Materials.

Scope of Use

These Terms apply to all Materials offered by AWL and Affiliates, whether provided for free, for purchase, or as part of any course, membership, or event.

License and Restrictions

  • License Granted: AWL grants you a limited, non-exclusive, non-transferable, revocable license to use the Materials for your own educational and limited professional reference purposes only
  • Prohibited Uses: You may not copy, reproduce, distribute, sell, sublicense, teach from, publicly display, or create derivative works from the Materials.
  • Excerpts: You may share brief excerpts with clients for educational discussion, but wholesale copying, redistribution, or adaptation is strictly prohibited.
  • Termination: Any violation of these Terms immediately terminates your license to use the Materials.

Access and Revocation

  • Access to Materials may require payment or registration.
  • AWL reserves the right to revoke access without refund if you violate these Terms.
  • You may not attempt to circumvent any paywall, access control, or security feature

User Representations

By accessing the Materials, you represent and warrant that:
  • You are at least 18 years of age and legally able to contract.
  • You are using your own payment method or are authorized to use the payment method provided.
  • You will not use the Materials for any unlawful purpose or in violation of these Terms

Intellectual Property Rights

  • All Materials are the property of AWL and protected under U.S. copyright and other laws.

  • No ownership rights are transferred to you under these Terms.
  • You may not create derivative works, adaptations, translations, or use the Materials to develop competing products.

Payment, Refunds, and Chargebacks

  • Payment Required: Payment must be made in full before access is granted.
  • No Refunds: Because the Materials are digital products, all sales are final. Once purchased or accessed, no refunds will be issued.
  • Chargebacks: By purchasing, you agree not to initiate a chargeback without first contacting AWL at business@ajanaclairwiselaw.com and allowing us a reasonable opportunity to resolve the matter. If you initiate a chargeback in violation of this clause, AWL reserves all rights and remedies, including legal action to recover amounts owed, plus costs, attorneys’ fees, and interest.

Limitation of Liability

To the fullest extent permitted by law:
  • The Materials are provided “AS IS” without warranties of any kind.
  • AWL disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising from your use of the Materials.
  • AWL is not responsible for third-party platforms, websites, payment processors, or security breaches, including any loss of data, unauthorized charges, or system failures.

Separate Agreements

Purchases of legal services, memberships, Strategic Legacy & Asset Planning (SLAP) sessions, or other client services are governed by separate written agreements and are not covered by these Terms.

Enforcement and Remedies

  • These Terms are governed by the laws of North Carolina.
  • Exclusive venue lies in the state courts of Mecklenburg County, NC.
  • You and AWL waive the right to a jury trial.
  • AWL may seek injunctive relief and all other remedies available at law or equity for violations of these Terms

Enforcement and Remedies

If you believe your copyrighted work has been copied in violation of law through our Materials, you may notify us at business@ajanaclairwiselaw.com. Your notice must comply with the requirements of the Digital Millennium Copyright Act (DMCA).

Privacy

Your use of the Materials is also subject to our Privacy Policy, which is incorporated by reference.

Changes to Terms

AWL may update these Terms at any time in its sole discretion. The updated Terms will be posted with a new effective date. Continued use of the Materials constitutes acceptance of the updated Terms

Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and AWL regarding the Materials.
  • Severability: If any provision is held invalid, the remainder remains in full force.
  • Waiver: Failure to enforce any provision is not a waiver of our rights.
  • Assignment: AWL may assign its rights and obligations under these Terms; you may not assign yours without prior written consent.
  • Survival: Sections 5–10 and 12–14 survive termination of these Terms.
